Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") form a binding agreement between you and SPECTAVIA ([SPECTAVIA GmbH, registered in [CANTON]], Switzerland; "SPECTAVIA", "we", "us"), governing your use of the SPECTAVIA application, website, and related services ("the Service"). By creating an account, downloading the app, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 13 years old (16 in certain EU jurisdictions) to create an account; minors need parent or guardian consent. Provide accurate information, keep your credentials secure, and use one consumer account per person. You may close your account at any time in the app (Account → Delete account). We may suspend or terminate accounts that violate these Terms or applicable law, with reasonable notice except in urgent legal or security cases.

3. The Service

SPECTAVIA delivers verified spatial and stereoscopic photography of motorsport through native applications on iOS and iPadOS and on the web at spectavia.com. The launch release covers the race weekend at Circuit Zandvoort, 21–23 August 2026.

4. Use of content

Subject to these Terms, SPECTAVIA grants you a limited, non-exclusive, non-transferable, revocable licence to view content within the Service, cache it on your devices for offline viewing, and use it for personal, non-commercial purposes.

5. Intellectual property

All content, software, trademarks, logos, and designs associated with the Service are owned by SPECTAVIA, its licensors, or partner photographers. All rights not expressly granted are reserved. These Terms grant no right to use the SPECTAVIA name, marks, or related brand vocabulary without written permission. Where content carries photographer attribution, it must be preserved. Feedback you provide may be used by SPECTAVIA for any purpose without compensation.

6. Independence

SPECTAVIA is an independent platform. It is not affiliated with, endorsed by, or sponsored by any motorsport series organiser, circuit operator, racing team, or driver. Any third-party trademarks appearing incidentally in photographic content are present for editorial identification only and remain the property of their owners.

7. Third-party platforms

Your use of the Service on Apple platforms is also subject to Apple's terms. Apple is not a party to these Terms and has no obligation to provide support for the Service.

8. Privacy

Your privacy is governed by our Privacy Policy. By using the Service you also agree to it.

9. Disclaimers

To the maximum extent permitted by law, the Service and content are provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, or non-infringement, and we do not warrant uninterrupted, secure, or error-free operation. Nothing in these Terms removes statutory consumer rights in jurisdictions where they cannot be excluded (including the EU/EEA, UK, and Switzerland).

10. Limitation of liability

To the maximum extent permitted by law, SPECTAVIA's total liability for all claims relating to the Service shall not exceed the greater of the amount you paid us in the preceding 12 months or CHF 100, and we are not liable for indirect, incidental, consequential, special, or punitive damages. These limitations do not apply where excluded by mandatory consumer-protection law.

11. Indemnification

You agree to indemnify SPECTAVIA against claims, damages, and reasonable expenses arising from your breach of these Terms, your violation of law or third-party rights, or your misuse of the Service or content. This survives account closure.

12. Disputes

These Terms are governed by Swiss law, excluding conflict-of-law rules and the CISG. Disputes are resolved by the ordinary courts of [CANTON], Switzerland; EU/EEA/UK consumers may also bring proceedings in their country of residence, and Swiss consumers in their canton of residence. Before litigating, please contact legal@spectavia.com — we respond within 30 days. EU consumers may also use the EU Online Dispute Resolution platform.

13. Changes and general provisions

We may update these Terms; material changes will be notified by email and in the app at least 30 days before taking effect. These Terms and the Privacy Policy are the entire agreement. If any provision is held invalid, the rest remain in force. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in a merger, acquisition, or asset sale. Notices to you go to your registered email; notices to us go to legal@spectavia.com.
